Terms and Conditions of Participation and Privacy Notice

1. Organizer
The organizer of the giveaway is CHERRY SE, Rosental 7, c/o Mindspace, 80331 Munich, Germany.

2. Participation
All persons aged 18 and over are eligible to participate. Participation is possible worldwide. Employees of CHERRY or involved sponsors and partners, as well as their relatives, life partners, or persons living in the same household—provided these persons were or should have been aware of the employee’s involvement in the giveaway—are excluded.
Depending on the winner's country of residence, the prize may be subject to taxes or customs duties. The winner is responsible for obtaining information about applicable national tax and customs regulations and for complying with them.

Open to EU and US residents only.

3. Duration
The giveaway runs from February 6th to February 13th, 2026. CHERRY reserves the right to terminate or modify the giveaway early for important reasons (e.g., technical issues or legal changes).

4. Prizes and Draw

1. 5 x Steam keys for the game REANIMAL.
2. 5 x CHERRY XTRFY GP5 REANIMAL edition mousepads.

Five winners will win one set each, containing a steam key and a mousepad. Winners will be chosen at random. 

5. Notification
Winners will be informed via the contact method provided in the giveaway entry. They must respond within two weeks. Otherwise, the claim to the prize will expire. A cash payment or transfer of the prize is excluded.

6. Content Submitted by Participants
Participants are solely responsible for uploaded content. If the participant submits photos or videos showing people other than themselves, submission is only allowed if the depicted individuals have given their consent and their personal rights and data protection rights are not violated. Photos or videos not taken by the participant may only be submitted with the copyright holder’s consent. All content must not infringe third-party rights or violate any laws. If rights are violated, the participant shall indemnify CHERRY from any third-party claims.

7. Publication
CHERRY may publish the names of winners and submitted content in connection with the giveaway (e.g., on social media). Objections can be made at any time.

8. Platforms
If the giveaway is hosted on an online platform (e.g., Instagram, Facebook), the following applies: There is no connection between the giveaway and the respective platform. The giveaway is neither organized, sponsored nor supported by the platform. All inquiries or notices regarding the giveaway must be directed exclusively to CHERRY.
Data processed as part of the giveaway will be used solely by CHERRY, not by the platform. Processing by the platform may occur independently, e.g., when participants enter login data or post content.
The terms of use and privacy policies of the respective platform also apply.

9. Liability
CHERRY is only liable for damages caused intentionally or through gross negligence or for breaches of essential contractual obligations (cardinal obligations). In the case of simple negligence, liability is limited to foreseeable damage. Liability for damages resulting from injury to life, body, or health remains unaffected.

10. Data Protection
In the context of the giveaway, we process personal data (e.g., name, email address) solely for the purpose of conducting the giveaway and notifying the winners. Data will only be stored as long as necessary for the administration of the giveaway and will then be deleted. The legal basis is Art. 6 para. 1 lit. b GDPR. Disclosure to third parties only occurs to the extent necessary to conduct the giveaway.
Data subjects have the right to access, rectification, erasure, restriction of processing, data portability, and the right to object to processing, as well as the right to lodge a complaint with a supervisory authority.

11. Legal Recourse
